Education

Michael D. Chiumento III graduated from the University of Central Florida in 1994 with degrees in Civil Engineering and Liberal Studies. Mr. Chiumento III received his law degree from the University of South Carolina in 1999.

Personal History

Born in Florida, Michael has lived and worked in Volusia & Flagler County since 1973. For more than 30 years, he has been a volunteer, community leader and business owner. Michael obtained degrees from the University of Central Florida in Engineering and Liberal Studies in 1994. Afterward, he practiced as a Civil Engineer designing, permitting and constructing subdivisions and government infrastructure.

In 1999, Michael received his law degree from the University of South Carolina and returned to Flagler County to practice law. Since his return, Michael’s focus has been on raising his family, building his practice and the firm, and the growth and success of our community.

Michael specializes in Personal Injury and Real Estate. He represents institutional clients, developers, lenders, local governments, and individuals in all areas of real estate sales, including acquisitions and financing, entitlements and development of real property.

Michael lives in Ormond Beach with his wife and three children.

Areas of Practice

Commercial Litigation

Since the beginning of his legal career, Michael has been entrusted with representing individuals, families and businesses in various types of lawsuits. Although he believes that the best result to any dispute is through mediation or mutual settlement, Michael knows that thorough efficient and respectful litigation is sometimes necessary. Michael focuses on Commercial Litigation which is broadly defined but includes Landlord/Tenant Disputes, Corporate and Shareholder Disputes, Contract Actions and Disputes, Construction Litigation, and Eminent Domain/Inverse Condemnation/Bert Harris Actions.

Personal Injury Law

Michael represents the people of this community, their friends, and their families who have been unfortunately affected by personal injury or wrongful death matter. Michael’s personal injury practice focuses on car, truck, motorcycle, or boating accidents, slip and fall accidents, and construction accidents. Land Use & Zoning Law

Michael represents individuals in all facets of real estate sales, acquisitions and financing, entitlements and development of Real Property. Michael’s experience includes real estate closings, title matters, condominium development and conversions, title insurance, land use, zoning, DRI(s) and Community Development Districts. In addition to representing many of Florida’s most prominent real estate developers in notable projects such as Town Center at Palm Coast (DRI), Palm Coast Park (DRI) and Grand Haven, Michael also represents various lenders including Ameris Bank, Intracoastal Bank, and Sun Trust in secured transactions. In addition, Michael’s Real Property Law practice includes assistance and representation in the analysis of complex business transactions and negotiation and drafting of business agreements.

Probate Law

Michael advises the personal representative of the deceased and provides probate services throughout all steps of the probate process including: filing a petition to name a personal representative, marshalling and valuing the assets and debts of the estate, notifying creditors and other interested parties of the probate action, counseling personal representatives on the actions they must take to fulfill their fiduciary duty, ensuring the payment of outstanding debts and tax obligations, distributing of the remaining estate assets according to the wishes of the decedent. In addition, Michael represents those who may be involved in will contests, probate litigation, personal representative (executor)  malfeasance, trust litigation, trustee malfeasance, undue influence in the creation of a will or trust, or financial abuse of the elderly.
